Well can’t tell you for sure the situation where you are. In ND the road in most cases is an easement not title ownership. State highways the state owns. Even if the county paid for a wider easement, it is still an easement.

Someone with an easement cannot give other easements legally, but some counties here do it all the time.

Waiting for someone to really nail them.

I would add that the ditch next to a road is a really bad location for cables and pipelines because at some point someone might need to build up the road and then that cable or pipeline often granted for nothing becomes a potential huge problem.
