You always have the option to refuse the facial recognition scan. It is law. It just means a person compares your passport or ID picture instead of a machine.
TSA is required to post signage at the scanners that you have the option to refuse. They often don’t have the signage out as required, or obscure it in some way.
"IT" is not law.
