I like the idea of a hard cap but just not sure it will accomplish what it is intended to.

I am not large enough to be over the $40,000 cap but if I was. I have two daughters who do not farm but own a share (small share of a LP). I would just set them up to be the operators with their SS# on the land that they have an interest so they would get farm payments. Going the next step I rent some land from my parents. All of a sudden they would be operators of their land. I have POA over their checkbook so it would be set up to look like they are paying for inputs but it would be me paying.

I like your idea but am sure there will be ways around it.
