Time of day should have nothing to do with it. Even if they were pulled over at 3am the officer's actions were illegal and your son should probably sue them for violating his rights and putting him through this BS.
Even though the county attorney made the right decision, the officer still won't be held responsible for his illegal actions. The only way to make sure that is done is to sue the officer and his employer.
