I think you will find that in the Midwest most judges are going to rule probable cause with two under age men driving a pickup with a cooler in the back. Having pulled them over for speeding already opens the door. The cooler being in plain site in the bed of the truck further opens it. He did not have to search anything to see the cooler. After seeing it I think a judge is going to rule probable cause. I think his best option is to have the owner of the truck explain to the judge that he inadvertently left the cooler and beer in the the truck and forgot about it when he let the boys take it. I think they stand a better chance of getting the charges dropped that way than storming into court and arguing probable cause. | |
