That the producers don't want to testify. I think Syngenta lawyers would change their minds pretty quick if 5000-6000 producers all showed up in court with national television cameras. Now I didn't plant any of their unapproved seed but I got hurt as well and argue that I should recover as well simply because corn that couldn't and wasn't shipped to China had to be used domestically and that in turn depressed the domestic market.
The simple fact is the Syngenta company officials were not just negligent but reckless. They knew or should have know the potential consequences of their actions. In effect, they didn't just unknowing drive too fast for conditions (negligent) but drove drunk (reckless). The fact that they marketed their seed with the warning that it couldn't be sold into trade show clearly that they knew the potential. Simply having a producer sign a statement acknowledging the warning isn't enough. There should have been a system of positive control, numbered fields, harvest records, storage records etc. etc. to prevent what happened. And don't say it's not possible because organic & non-GMO crops are marketed in just that fashion today.
