Subject: RE: Property line and barn

central nebraska
There is an ag law called adverse possession or fence laws, one of those two. The way I understand it if a piece of property is farmed a certain way for a certain amount of time. I think 10 years would be enough.

Even though the fences do not follow the exact property line a new property line has been established by the way it is farmed or used. As long as both parties have not disputed the line within the time frame that it has been farmed.

It's been awhile since I took aglaw in college, but I remember the professor saying if I fenced off a small portion of pasture that someone else owns, and I use it for whatever purpose I want, and the landowner does not say anything about it for say 10 years(not sure on the amount of time), that piece of property that I fenced off and used is now legally my land.

I think you are ok. If the fence or fence posts are there and everyone thought that was the property line.
