I can speak on this as we are going through this right now on a wreck last November.
I can tell you that the insurance company is only liable for the maximum the insured is covered for on the policy. If they only carry 50k personal liability coverage,Which is the state minimum in most states, that is all the company is going to have to pay.
If you think you deserve more, you have to get it from the person driving.
