The various states have lawyers in the legislature who have helped enact a variety of laws during the past 150 years. Most states now have laws that allow you to collect for punitive damages if you can prove the other party was grossly negligent. Most states also allow you to collect for actual damages such as medical cost, transportation to obtain medical assistance, damages to your vehicle and property, loss of use of vehicle, lost wages, etc. Compensation for lost wages is normally based on the injured person's income. Some states also allow compensation for pain, suffering and mental anguish, etc. These damages are normally paid by the other parties liability insurance subject to the limits of their policy, your uninsured or underinsured motorist coverage or by taking property or wages from the other party.
