But the issue is "near water". That is totally up to what the EPA decides that is and it can be whatever they want it to be. It's very vague. It could be 2 feet or it could be 20 feet. I don't think we'll find out until somebody gets nailed. And it will vary by state from what information I can get...which isn't much.
