Dietrich, Idaho and Mountain Home, Idaho
Ownership of the frequencies isn't the issue. The issue is using frequencies that are meant for weak satellite signal transmission for terrestrial(land based) signal transmissions that are billions of times stronger. The terrestrial based transmission of signal will "drown out" the weaker satellite signals since the frequencies are so close to each other. If lightsquared wasn't trying to bend the rules this wouldn't be an issue at all. All that has to be done is for lightsquared to use the frequencies they already own for what they were intended(satellite transmission of signal) and if they want to supplement their signal with land based signals then buy land based frequencies(much more expensive).
