Sounds like he wants more equality between farmers, where all growers are treated similarily and all given the same options? No? Thats like saying to the CWB, "We don't want you anymore, but oh hey, while your here you have to treat us all fairly, share and make sure everyone gets the same amount of cookies as the other guy". Seriously what do you guys expect when the CWB is gone? Free cookies for everyone? Give me a break. In some ways I fear that the potential dissolving of the CWB will have a negative impact on farmers bottomline as they might not be ready, or fully understand how, to market 100% of their grain and they will faulter. Time will tell.
Does the CWB treat you fairly? Your answer is probably "No." Same as mine. I don't expect it though, what interest is it to the CWB to treat farmers fairly? They are not going to return profit to you by treating everyone fairly, and satisfy everyone's complaint. Like I said, the CWB exists as of today, you have to learn to work with it or find some way around it, Viterra's IP programs are your start. Unless you can somehow get your board grain out of the country to a buyer without anyone knowing, or you can convince other company's to start IP Durum programs.
As per the farmer reference story, if Viterra graded it a #3 then they should have provided him with some type of statement indicating that his durum is no longer in the IP program contracts. Once that is settled by both sides (Viterra and the farmer), Viterra has no bond with that grain any longer. He is free to take it where he wants.
How did the Viterra get wind of another elevators grading specs for his durum in the first place? Was he in Viterra blowing steam off saying he could get a better grade elsewhere? Or was the other elevator leaking this out? If he was blowing steam, thats your #1 biggest mistake right there. Keep your yap shut til the signature is done. If 'another elevator' was leaking information about his grades then that is a breech of confidentiality, of which should not be made public. I would have taken that up with the other elevator. Maybe it was the other elevator that he should be mad with? Either way, this farmer dealt with this the wrong way. Any grade descrepscies within Navigator durum should not be dealt with by another elevator, but with the CGC. Not Viterra's fault or the CWB for that matter, it was his.
Another elevator, other then Viterra, cannot buy Navigator grain, if they do, Viterra can take legal action against the other elevator. It shouldn't have been of interest for another elevator to buy it or even grade it for that matter. If he did sell it to the other guys without Viterra releasing it, Viterra will want to know where it went, and they will find out, trust me.
I am still unsure how this farmer lost money on grading by going to a #2 from a #3, considering the price is better for a #2.
Are you saying he hauled the grain out of the bin, put it in a pile, then put it back in the bin? (What happened to the other 25000 bu?)
Was this a sampling issue? Did he not provide proper samples? Otherwise I don't see any need for that. You are required to provide proper samples of each bin, but he should have collected those samples when he filled the bin at harvest. He must have really pissed them off if they resorted to this, thats the first I have ever heard of that jargon, from any elevator. I would have went as high up the Viterra ladder as I could to put that fire out, or at last resort, to the CGC. He could have saved himself a lot of hassle if he would have handled this right from the start.
Hauling at inconvinent times, like when, seeding? I hauled 25% of 2008's Navigator production during seeding of 2009. And there was just as many generic contracts coming in as IP, thats when the cars showed up, thats when it was needed, nothing Viterra can do about trains or rail orders. Buyers/shippers don't stop buying/shipping when we are busy seeding, they could probably care less. Get used to it.
