Well, the IRS requires you to send in the 1099, so you are subject to the penalties for failing to do so if caught. Landowner would of course be responsible for the taxes that should have been paid and the related penalties.

If a landlord wants to cheat, I don't want any part of it. Not the best person to do business with, as people rarely only cheat one entity. I certainly would be afraid that the landlord would cheat me too if given the chance, so claiming that the rent went unpaid would be high on the list of concerns. I would offer a crop share lease instead, then any cheating scheme would be the landlord's own doing if he/she wants to try to sell grain for cash.
