SE Iowa
I have a tile main that runs thru my neighbors field that has become exposed because of careless farming practices. It was owned by a lady who is over 100 but she gave it to the state several years ago. It has been rented out to the same guy for quite a few years. He is the one respondsible for farming thru the slough where the main lays. The owner will keep control of the property until her death even though Iowa is the owner as the plat book shows and they also put up signs around the perimeter. This is good farm land and will probably remain farm land after she passes but who knows. There has been an intent shown to terrace this area but nothing has been done so far. The eroded ditch has just backed up to our property line and will soon be cutting into my property. How should I procede? The tenant is "out there", the state does not have full control, and the lady only listens to her tenant.
